Terms & Conditions

ALL ORDERS ARE BOUND BY THESE TERMS AND CONDITIONS DUE TO THE BESPOKE NATURE OF OUR BUSINESS, ORDERS CANNOT BE CANCELLED OR RETURNED ONCE AN ORDER HAS BEEN PLACED

1. DAMAGED ITEMS UPON DELIVERY

Any damages must be reported within 24 hours of installation. If we agree damage is at our fault, they will be remedied FOC. If we deem damage is by the customer/third party, then a new purchased order is required for the damaged articles and labour to install.

2. GLASS - Glass provided will have polished edges, square, dubbed or radius corners. Acceptable visual tests for the acceptance of glass and surfaces, a document has been issued if not received please request. Typical distance for viewing Glass 1.5m and for Metalwork is 3m without direct sunlight or artificial lighting. You agree with the terms detailed in our Important Information About Glass Laminated Glass edges may not be 100% flush; glass of this type can be as much as 3mm out of line resulting is a small step in the glass which is in accordance with BS EN 12543:2011

3. STEEL 3.1 Stainless steel There are many grades of stainless steel, we use both 304 for internal and 316 for external application.

3.2 Grade 304 is the most common stainless steel and satisfies a broad demand for adequate performance at an affordable price. It has good corrosion resistance in a wide variety of environments. It is the best choice for indoor use (except swimming pools).

3.3 Grade 316 has a higher level of corrosion resistance and is often referred to as marine grade. Typical applications are architectural components where they are exposed to extreme weather conditions and climatic conditions, such as near the coast, near heavy industrial sites or in/around swimming pools.

3.4 Stainless steel is not maintenance free but maintenance friendly and when using stainless steel material outdoors, you need to clean periodically, especially in aggressive environments like coastal areas or swimming pools. The chlorine rich atmosphere driven in from the sea can affect in-land stainless as far as 20 miles from the coast.

3.5 Maintenance Besides pollution by industry, traffic and maritime influences also the choice of materials and surface treatment play an important role. Environmental factors determine how large the degree of pollution is and thus the cleaning method and frequency.

3.6 Warning: Stainless steel, which is not regularly and properly cleaned, pollutes and can eventually pass into corrosion of the product itself. If pollution or inadequate maintenance takes place this will pass into persistent pollution which can lead to corrosion (contact). Corrosion can eventually be at the expense of durability but in each case the appearance. And it is precisely for this last reason often stainless steel is chosen.

3.7 Light contamination (surface rust) Light contaminated Stainless steel can be cleaned with an alkaline medium and rinsed with large amounts of clean cold water. After drying protect it with a stainless-steel protecting agent. Whit a properly cleaning frequency this simple treatment is sufficient. Although experience shows that many cleaning companies fear cleaning of stainless steel, even a slightly contaminated stainless steel can be easily cleaned with this simple cleaning procedure.

3.8 Heavy contamination (product rust) Heavy or persistent contamination (product rust) can only be cleaned with aggressive agents and therefore only by specialist companies. Regular cleaning companies do not have the expertise nor the resources to remove this. Apart from the cleaning a specialist Stainless steel cleaning company can also return its original shine, any damage as dents and scratches and give it a special protection.

3.9 Maintenance, cleaning and protective equipment Apart from the normal, commercially available cleaners, there are also specially developed agents for stainless steel cleaning products.

4. ALUMINIUM

4.1 Standard All aluminium profiles meet European standard EN573-3 for chemical composition. All glass profiles are produced from alloy 6063-H T6, the rest of the profiles from alloy 6063-T5 4.2 Maintenance Periodically cleaning will prevent a negative effect on the anodization layer. Anodizing layers are sensitive to acids, salts and other aggressive substances and wear out faster. In addition, thick dirt layers absorb more moisture and increases the corrosion of the anodizing surface.

4.3 Cleaning method:

4.3.1 Use of soft cleaning materials with no abrasive effect, such as cotton (do not use, steel wool or sandpaper etc.).

4.3.2 Use a neutral non-abrasive and PH-neutral (pH 6-8) cleaning agent. Do not use solvents (petrol, acetone), alkaline products (ammonia, sodium), acid products (sulfuric acid, acetic acid)

4.3.3 Rinse parts after cleaning carefully with plenty of fresh water. Sea salts must be removed as soon as possible.

4.3.4 Visually inspect the anodized layer after cleaning for areas where the integrity of the protective anodization layer is breached, in these areas’ professional restoration of the anodization layer is needed.

5. INSTALLATION

5.1 Hardstanding – Whilst we can advise on suitable materials for affixing our systems the preparation/installation of the hardstanding are outside of our scope of works, as such if a material has weaknesses due to quality or incorrect installation, we will not accept liability for any damages, this will include fractures, cracks or breaks in tiles, flags paving & coping stones, mortar joints separating, loose/separated materials. A solid, noncompressible, material is essential. If it becomes apparent during the installation that the hardstanding is unsuitable, we will need to postpone our works until suitable strengthening has completed by the client. A cost maybe incurred for a re-visit to site.

5.2 Substrates We have assumed that substrates are level to a 10mm tolerance. If additional structural packing is required, due to uneven surfaces, extra cost may be incurred.

5.3 Glass Spacing All systems to have no gaps at no greater than 99mm in line with Section K building control, where possible we will minimise these gaps.

5.3.1 Posts systems will typically have 22-25mm spacing between the posts and side of glass panels, 80mm spacing between the handrail and the top of glass panel and 50mm between the hardstanding and bottom of the glass panel.

5.3.2 Spigot systems will typically have 10-15mm of spacing between glass panels and 40mm between hardstanding and bottom of glass.

5.3.3 Channel systems typically have 10-15mm of spacing between glass panels.

5.3.4 Whilst these measurements are what we would typically expect, all systems where gaps do not exceed 99mm would be within our tolerances as they conform with building regulations.

5.4 Water Ingress

5.4.1 We do not accept any responsibility for water ingress or damages caused by water ingress as a result of our installations.

5.4.2 Whilst we take all precautions using polyester chemical resin anchor fixings the installation site as if we have top/side mount through a material designed to create a waterproof barrier we do so at the customers risk and do not accept any liability for water ingress.

5.4.3 Fixing to parapet walls we assume these are constructed to NHBC specifications with DPCs and cavity trays linked to the waterproofing layer upstands and suitable thickness for substrate above for the fixing of our product. Any drip trims / capping is provided for visual purpose & cannot be solely relied upon for waterproofing. Any water ingress the responsibility of the customer following installation.

6. Balcony balustrades are installed to withstand 0.74kn loading unless otherwise stated.

6.1 Balustrades to internal staircases & patios where the potential fall is less than 600mm will be installed to withstand 0.34 Kn loading.

7. Our quotation does not include for removal or disposal of existing balustrade systems.

7.1. Protective packaging disposal will remain the responsibility of the client.

DELIVERY

8. Any time or date for delivery of the Goods given by the Company shall only be an estimate. The Company from time to time shall use external couriers and therefore, cannot guarantee the time of delivery, we can however provide the couriers details to track, we will use reasonable endeavours to ensure your delivery arrives on the day agreed unfortunately we cannot GUARANTEE DELIVERY, time of delivery shall not be of the essence and the Company shall not be held liable for any loss or damage howsoever resulting to the Customer by reason of delay in delivery. Please do not arrange for Builders, Contractors to install/attend until you have received all your items, checked for damages and accuracy. Standard Delivery Times are between 7am and 6pm.

9. Some Couriers have dedicated days for certain postcode areas. This may mean a choice of dates may not be available to you, the customer. These dedicated days can be provided on request. This is a third-party service and outside the control to some degree of Wernfab.

10. Any date provided by Pink Sand Group is the day your delivery leaves the depot. Most areas are delivered same day however some areas will receive delivery on DAY 2. This may be subject to legal driving hours, traffic, weather and route creation.

11. The Company shall be entitled to determine, in its reasonable opinion, the actual method, date and time of delivery and will not be obliged to deliver Goods outside mainland England, Scotland and Wales. Delivery of the Goods shall be deemed to take place when the Goods arrive at the address designated for delivery. It is important to note that in most cases the materials will be offloaded by hand depending on the nature of your purchase. No Hiab will be available.

11.1 The Customer shall ensure that the Company (or its agent or carrier as applicable) shall have sufficient access to the designated premises for delivery to enable safe and proper delivery of the Goods. Your delivery may not be outside your property or construction site etc if access is not available. It is your responsibility to advise if the access, delivery address has weight limits, restrictions, obstructions that could prevent the delivery from happening. If this obligation is not fulfilled by the Customer, the Company may charge the Customer for any additional costs and expenditure incurred by the Company as a result of such failure. The delivery vehicle may be large, please ensure access is available at chosen delivery point.

11.2 The Company shall be entitled but not required to deliver the Goods in instalments (multiple delivery’s dependent upon item & third-party supplier) and to invoice the Customer for each instalment. Goods will be placed as near to your property, development, delivery address as the driver deems safe to do so. The Driver at his discretion will decide for health and safety reasons whether the goods are left kerbside or on your property. Glass Deliveries will require adequate 2 people to unload. The driver may assist if they think possible however the driver or Pink Sand Group will not be responsible for damage during unloading. The glass will be passed panel by panel from the back of the vehicle. If the driver deems that the access is not suitable for whatever reason they are within their rights to refuse to unload or they can leave it as near to the delivery point as possible. If the surface is uneven, soft, gravel, grass, inclined and the driver is unable to manoeuvre a pallet truck he is within his right to refuse delivery. If the customer has not made us aware of this at point of arranging delivery additional charges to the customer may apply. The goods are generally very considered heavy (some glass panels 60kg) therefore, deliveries are made curb side only.

11.3 We strongly advises that no installation plans are implemented until the Buyer is in receipt of the Goods and fully satisfied with the product. No reimbursements will be offered for any Buyer's costs incurred due to neglect of the previously mentioned.

11.4 Dates or periods quoted for delivery or installation of Goods are approximate, given for reference only and time for delivery shall not be of essence unless previously agreed in writing by ourselves.

11.5 Failure for any reason of Wernfab to comply with delivery dates shall not constitute a breach of contract and shall not entitle the Buyer to treat the contract as terminated or to any other remedy against Wernfab.

11.6 If the Buyer fails to take delivery of the Goods or any part of them on the pre-arranged delivery date and/or fails to provide any instructions, documents or consents required to enable delivery of the Goods, we shall be entitled to store or arrange for the storage of the Goods and then risk in the Goods shall pass to the Buyer.

11.7 In the event of Clause 6.5, delivery shall be deemed to have taken place, and the Buyer shall pay to us all costs and expenses relating to the subsequent storage and insurance costs along with the cost for re-delivery of Goods.

11.8 In the event that we fail to deliver Goods on a specified delivery date outside of the Company’s reasonable control or be it the Buyer’s or carriers fault we shall hold no liability in respect of such late delivery.

11.9 Deliveries will need to be manually handled (Kerbside) from vehicles, some of these products can be heavy and as such the buyer will need to ensure they have the capability to receive the goods. We would recommend a team of at least two persons be available to receive orders.

12. Supply only balustrades, selection of the correct balustrade for building regulations lies with the buyer, although we are happy to advise.

13. Commencement on site payments are due by end of next working day or works will terminate.

13.1 Final payment for completed jobs due withing 5 days of completion unless we are informed in writing with photos of any defects within 24 hours of our site attendance.

13. WARRANTIES, LIABILITY AND QUALITY

13.1. Subject to delivery access conditions being met, the Company warrants that the Goods shall be delivered to the Customer in a materially undamaged condition and free from any material defects. 5.2. If any of the Goods are defective and are covered by the warranty in clause 5.1 above the Company shall at its sole option either supply replacement Goods or refund the price which has been paid by the Customer for the defective Goods. Such replacement or refund shall be the Customer’s sole remedy in respect of any claims it has under the warranty given by the Company in the Claus above.

13.2 Our standard warranty period for our installations for workmanship is 5 years, this dose not include storm damage from `named` storms in the UK.

13.3 Discolouration to any item including stainless steel, please note some discolouration will occur over time if the balustrade is not cleaned on a weekly basis, with soap & water, please do not use abrasive. As detailed in clause 3.6.

LATE PAYMENTS

14. Late payment charge in line with direct.gov guidelines, plus statutory interest’ - this is 8% plus the Bank of England base rate shall be charged for invoices older than 30 days.

14.1 All products once installed remain the property of Wernfab until payment is made in full. Wernfab may take measures to repossess any unpaid items.

15. Payment of deposit is confirming agreement to all our terms & conditions.
